This volume provides the first English translation of Hans Kelsen's and Carl Schmitt's influential Weimar-era debate on constitutional guardianship and the legitimacy of constitutional review. It includes Kelsen's seminal piece, 'The Nature and Development of Constitutional Adjudication', as well as key extracts from the 'Guardian of the Constitution' which present Schmitt's argument against constitutional review. Also included are Kelsen's review of Schmitt's 'Guardian of the Constitution', as well as some further material by Kelsen and Schmitt (...) on presidential dictatorship under Article 48 of the Weimar Constitution. These texts show Kelsen and Schmitt responding to one another, in the context of a debate focused on a concrete constitutional crisis, thus allowing the reader to assess the plausibility of Kelsen's and Schmitt's legal and constitutional theories. The paper develops a framework to evaluate a network's stakeholders' perceptions concerning an issue which is highly relevant for all stakeholders. The framework helps us to understand how stakeholder networks impact perceptions and vice versa, which will result in a better understanding of the interrelatedness of a network. On the other hand, it helps corporations to become more effective increating wealth with and for their stakeholders.

Rethinking politics in a new vocabulary, Hans Sluga challenges the firmly held assumption that there exists a single common good which politics is meant to realize. He argues that politics is not a natural but a historical phenomenon, and not a single thing but a multiplicity of political forms and values only loosely related. He contrasts two traditions in political philosophy: a 'normative theorizing' that extends from Plato to John Rawls and a newer 'diagnostic practice' that emerged with Marx (...) and Nietzsche and has found its three most prominent twentieth-century practitioners in Carl Schmitt, Hannah Arendt, and Michel Foucault. He then examines the sources of diagnostic political thinking, analyzes its achievements, and offers a critical assessment of its limitations. In trying to assess Hannah Arendt’s approach to the problem of pluralism of the political it is illuminating to contrast her views with Carl Schmitt’s concern with pluralism. The author argues that in renewing Schmitt’s question „what is politics?”, Arendt turned herself into a political theorist and that in trying to answer this question she came up with the conclusion that politics rests on the fact of human plurality. In relating Arendt and Schmitt in this way one (...) has to keep in mind, however, that their real and substantive affinities have always been qualified by equally real and substantial disagreements. Careful scrutiny reveals that Arendt was certainly familiar with many of Schmitt’s writings and that she regarded him highly as an outstanding scholar, a jurist with ingenious theories, and a most able defender of his views. But she constantly qualified her praise for she has also seen Schmitt as a scholar who did his utmost to supply the Nazis with ideas and techniques. Key words PLURALISM, ARENDT, SCHMITT. (shrink)

We can pinpoint almost to the day the moment at which Hannah Arendt became a political theorist, and we can name with precision the experiences that made her one. Born in 1906, she had led a substantially apolitical life until Hitler gained power and she fled Germany in 1933. In Paris, she became an activist, busy in Jewish refugee affairs but with little time for abstract reflection. Appealing to the original meaning of the Greek term nomos, Hannah Arendt claims that a bounded legal space is constitutive for political community. Can this seemingly anachronistic claim be substantiated in the conceptually strong sense that every polity - the Greek city-state as much as a hypothetical world state - must constitute itself as a nomos? It is argued that whereas Arendt falls short of justifying this claim, a reflexive reading of nomos can do the trick: the space of political (...) community is necessarily bounded because no polity is imaginable that does not raise a claim to an inside as the community’s own space. A world state, were it ever to be founded, would globalize nomos, not suppress it. Whence the political problem: how does a polity deal with its outside? This problem is particularly pressing because Carl Schmitt’s defense of nomos radically challenges Arendt’s position. A reinterpretation of her analyses of the foundation of a political community suggests how the representational structure of a politics of boundaries parries Schmitt’s challenge. (shrink)

Heidegger’s critique of European nihilism seeks to expose self-legislation as the governing principle of central manifestations of modernity such as science, technology, and the interpretation of art as aesthetics. Need we accept the conclusion that modern constitutional democracies are intrinsically nihilistic, insofar as they give political and legal form to the principle of collective self-legislation? An answer to this question turns on the concept of power implied in constituent and constituted power. A confrontation of the genealogies of modern subjectivity proposed (...) by Heidegger and Blumenberg suggests that there is indeed a metaphysical core to the concept of constituent power developed by various political theorists, including Schmitt and Habermas. By contrast, closer consideration of the paradoxical relation between constituent and constituted power illuminates the ambiguity of collective self-legislation, which means both enactment of a legal order by a collective self and the enactment of a collective self by a legal order. To the extent that constitutional democracies are a way of preserving rather than dissolving this ambiguity, they imply an interpretation of power and human finitude that parries the charge of nihilism. To understand the complex religious dynamics in a globalizing world, Arjun Appadurai's view on imagination as a social practice, Charles Taylor's view on social imaginaries, and John Dewey's view on moral imagination are discussed. Their views enable us to understand religious dynamics as a “space of contestation” in which secular and religious images and voices interact, argue, and clash. Imagination can be used in violent ways in service of extremist world images that spread over the world by the intensive use (...) of social media. This raises an urgent question for psychology of religion: what enables people psychologically to engage in religious pluralism, understood as negotiating and perhaps stimulating diversity in non-violent, constructive ways? It is argued that dialogical psychology helps us to understand the self as the anchor point and navigational system of the social imaginaries that are at play in religious dynamics. (shrink)

We classify the measures on the lattice ℒ of all closed subspaces of infinite-dimensional orthomodular spaces (E, Ψ) over fields of generalized power series with coefficients in ℝ. We prove that every σ-additive measure on ℒ can be obtained by lifting measures from the residual spaces of (E, Ψ). The measures being lifted are known, for the residual spaces are Euclidean. From the classification we deduce, among other things, that the set of all measures on ℒ is not separating.

Embryonic development and adult tissue homeostasis are controlled through activation of intracellular signal transduction pathways by extracellular growth factors. In the past, signal transduction has largely been regarded as a linear process. However, more recent data from large‐scale and high‐throughput experiments indicate that there is extensive cross‐talk between individual signaling cascades leading to the notion of a signaling network. The behavior of such complex networks cannot be predicted by simple intuitive approaches but requires sophisticated models and computational simulations. This article follows Deleuze in investigating the ways in which the symptom as a form of representation can be collapsed into immanence. Exploring the symptoms of schizophrenia and autism, it examines what implications such a collapse may have for the production of the symptom in its double articulation as representation and immanent production. The argument follows Deleuze and Guattari in asserting that symptoms hold an implicit limit for the social forms that deploy them. Arguing that schizophrenia, as one such limit, (...) has been successfully appropriated and deferred by postmodern capitalism, it is proposed that the proliferating symptom cluster of autism may indicate a new form of limit and that ‘‘becoming autistic’’ thus may have potential as revolutionary practice. The living mycelium networks are capable of efficient sensorial fusion over very large areas and distributed decision making. The information processing in the mycelium networks is implemented via propagation of electrical and chemical signals en pair with morphological changes in the mycelium structure. These information processing mechanisms are manifested in experimental laboratory findings that show that the mycelium networks exhibit rich dynamics of neuron-like spiking behaviour and a wide range of non-linear electrical properties. On an example of a single real (...) colony of _Aspergillus niger_, we demonstrate that the non-linear transformation of electrical signals and trains of extracellular voltage spikes can be used to implement logical gates and circuits. The approaches adopted include numerical modelling of excitation propagation on the mycelium network, representation of the mycelium network as a resistive and capacitive network and an experimental laboratory study on mining logical circuits in mycelium bound composites. Neuroscience is a multidisciplinary effort to understand the structures and functions of the brain and brain-mind relations. This effort results in an increasing amount of data, generated by sophisticated technologies. However, these data enhance our descriptive knowledge, rather than improve our understanding of brain functions. This is caused by methodological gaps both within and between subdisciplines constituting neuroscience, and the atomistic approach that limits the study of macro- and mesoscopic issues. Whole-brain measurement technologies do not resolve these issues, but rather (...) aggravate them by the complexity problem. The present article is devoted to methodological and epistemic problems that obstruct the development of human neuroscience. We neither discuss ontological questions nor review data, except when it is necessary to demonstrate a methodological issue. As regards intradisciplinary methodological problems, we concentrate on those within neurobiology and psychology. As regards interdisciplinary problems, we suggest that core disciplines of neuroscience can be integrated using systemic concepts that also entail human-environment relations. We emphasize the necessity of a meta-discussion that should entail a closer cooperation with philosophy as a discipline of systematic reflection. The atomistic reduction should be complemented by the explicit consideration of the embodiedness of the brain and the embeddedness of humans. The discussion is aimed at the development of an explicit methodology of integrative human neuroscience, which will not only link different fields and levels, but also help in understanding clinical phenomena. Émile Durkheim remains one of the most controversial, and deeply misunderstood, classics of social theory. His work differs from the dominant version of sociology that has essentially accepted the modernist self-description of contemporary societies; and it contradicts the individualism that has come to dominate the social sciences. One of the leading legal philosophers of this century, Kelsen published this short treatise in 1934, when the neo-Kantian influence on his work was at its zenith. An earlier, "constructivist" phase had been displaced by his effort to provide something approximating a neo-Kantian foundation for his theory. If this second phase represents the Pure Theory of Law in its most characteristic form, then the present treatise may well be its central text. And of Kelsen's many statements of the Pure Theory, (...) this one is surely the most accessible. A popular principle about grounding, “Internality”, says that if A grounds B, then necessarily, if A and B obtain, then A grounds B. I argue that Internality is false. Its falsity reveals a distinctive, new kind of explanation, which I call “ennobling”. Its falsity also entails that every previously proposed theory of what grounds grounding facts is false. I construct a new theory.

Why do we so often care about the outcomes of games when nothing is at stake? There is a paradox here, much like the paradox of fiction, which concerns why we care about the fates and threats of merely fictional beings. I argue that the paradox threatens to overturn a great deal of what philosophers have thought about caring, severing its connection to value and undermining its moral weight. I defend a solution to the paradox that draws on Kendall Walton's (...) solution to the paradox of fiction, developing his idea that it be extended to games. The solution takes games to involve make‐believe: in particular, players and spectators make‐believe that the outcome of the game matters. I also explore how the phenomenon extends beyond games. And I explore some moral implications: in particular, my view preserves the idea that we have reason not to impede others in their pursuit of what they care about. (shrink)
